Terms of Service
1. Who we are and what these terms cover
These Terms of Service ("Terms") are an agreement between you and Luis Enrique Ramirez Chavez, Fürbringerstrasse 4, 10961 Berlin, Germany ("Calupet", "we", "us"). They govern your use of the Calupet mobile app and website ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
How we handle your personal data is explained in our Privacy Policy.
2. What Calupet is
Calupet is a pet-care app. You can keep a profile for your pet, record and review your walks, share walks or routes with people you choose, take part in community features, and raise or receive lost-pet alerts in your area. Additional safety features — push notifications, SOS and hazard alerts, live location sharing, and trusted contacts — are being rolled out in a later release.
Calupet is currently a beta offered free of charge. Features may change, be added, or be removed as we develop the Service.
3. Eligibility
You must be at least 16 years old to use the Service. By using Calupet you confirm that you are 16 or older and can enter into a binding agreement.
4. Your account
Sign-in is passwordless: we email you a one-time code or a link. You are responsible for keeping access to your email account secure and for activity under your account. Tell us promptly at [email protected] if you think your account has been misused. You may hold one account for yourself; accounts are personal to you.
5. Acceptable use
You agree to use the Service lawfully and respectfully. You must not:
- post content that is illegal, hateful, harassing, or infringes others' rights;
- submit false or misleading lost-pet or safety alerts, or misuse alerts to harass, track, or locate a person;
- use another person's data, impersonate anyone, or share someone's location without a lawful reason;
- attempt to break, overload, scrape, reverse-engineer, or gain unauthorised access to the Service;
- upload malware, or interfere with other users' use of the Service.
We may remove content and suspend or close accounts that break these rules.
6. Your content
You keep ownership of the content you create — pet profiles, photos, walks, routes, posts, and comments ("Your Content"). You grant us a limited, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content only as needed to operate and provide the Service to you and the people you share it with (for example, showing a shared route to someone you send the link to, or a lost-pet flyer to nearby users). This licence ends when you delete the content or your account, except for copies the law requires us to keep or that have already been shared onward by others.
You are responsible for Your Content and confirm you have the right to share it. Do not upload other people's personal data (including photos of other people) without a lawful basis.
7. Moderation and reporting
Community content may be moderated. You can report content that breaks these Terms, and we may remove content or restrict accounts. In line with the EU Digital Services Act, where we act against your content we aim to tell you the reason and how to object, and we keep the required records of such decisions.
8. Location and sharing features
Walk recording and sharing use your device location, which you control through your device settings and in-app choices. When you share a walk, route, or your live location, you decide who receives the link; anyone with an active link can view what you shared until it expires or you stop it. Shared routes are trimmed near their start and end to protect your home. Use sharing responsibly and only for your own location or with the consent of others involved.
9. Not an emergency service; no professional advice
Calupet helps communities help each other, but it is not an emergency service and does not replace the police, animal services, a veterinarian, or professional advice. Lost-pet alerts, safety alerts, and live sharing depend on other users, connectivity, and device settings, and may be delayed or fail to reach anyone. Do not rely on the Service in an emergency — contact the appropriate authorities or your vet. Pet-health tracking is for your own record-keeping and is not medical advice.
10. Availability and beta status
The Service is provided during beta "as is" and "as available", without any promise of uninterrupted or error-free operation. We may change, suspend, or discontinue features, and perform maintenance, at any time. We will try to give notice of significant changes where reasonable.
11. Liability
Nothing in these Terms limits liability that cannot be limited by law — in particular liability for injury to life, body, or health, for intent or gross negligence, or under the German Product Liability Act (Produkthaftungsgesetz).
Subject to that, because the Service is provided free of charge during beta, our liability for simple negligence is limited to the breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible and on which you may reasonably rely), and in that case is limited to the foreseeable, typical damage. We are not liable for indirect or consequential loss, or for loss arising from other users' conduct, from alerts not being delivered, or from your reliance on the Service in an emergency (Section 9).
12. Suspension and termination
You may stop using the Service and delete your account at any time in the app. We may suspend or terminate your access if you break these Terms or the law, or if we discontinue the Service. On termination, your right to use the Service ends; Sections that by their nature should survive (content licence limits, liability, governing law) continue to apply.
13. Changes to these terms
We may update these Terms as the Service develops. If a change is material, we will update the date above and, where appropriate, notify you in the app. Continued use after a change means you accept the updated Terms; if you do not accept them, stop using the Service and delete your account.
14. Governing law and disputes
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove the protection of mandatory laws of your country of residence. The place of jurisdiction is Berlin, to the extent permitted by law. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
